WASHINGTON, D.C. — Friday, the U.S. Treasury Department and Internal Revenue Service announced guidance on the Clean Fuel Production Credit (45Z), issuing a notice of intent to issue regulations and a notice providing an initial emissions rate table, both requiring a 90-day public comment period. Americans for Clean Aviation Fuels (ACAF) — a coalition of America’s largest industries representing the full clean aviation fuels (CAF) value chain, including agriculture, transportation, energy and manufacturers — released the following statement:
“Friday's announcement is another unnecessary delay causing America’s farmers, biofuel producers, oil and gas producers and transportation partners to face needless and prolonged uncertainty. These credits were established to help invest in innovative clean fuels, aiding our rural communities, strengthening our economy and benefiting our environment. Delaying the final implementation further removes any opportunity to achieve our energy and economic goals,” Nick Boeyink, ACAF states director, said.
“We are reviewing the preliminary guidance, and we will work with our members and the incoming Administration to quickly align on rules that will give clarity to American industry partners to scale the clean aviation fuel market, unlock enormous economic benefits, secure our energy independence and support our American farmers.”
ACAF supports expanding the use and market for clean aviation fuels through federal policies such as the 45Z Clean Fuel Production Credit. In December, ACAF submitted a letter to the House Ways and Means Committee asserting that 45Z or a similar credit program should “run through at least 10 years, increase domestic sustainable aviation fuel (SAF) production, create jobs and help lower carbon emissions by faster implementation of bio-energy production goals.”
The 40B Sustainable Aviation Fuel Tax Credit expired at the end of 2024, with 45Z taking its place until the end of 2027.
